Agreement to Terms

By accessing or using Memable ("Service"), operated by One Silly App LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

Memable provides semantic memory storage and retrieval services for AI agents and applications. This includes our MCP server, API, dashboard, and related tools.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Store content that violates any laws or third-party rights
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Use the Service to transmit malware or harmful code
• Reverse engineer or attempt to extract source code from the Service
• Resell or redistribute the Service without authorization

Your Content

You retain ownership of the memories and content you store through Memable. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service.

Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees
• Provide accurate billing information
• Authorize recurring charges for subscription plans

Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

Free Tier Limitations

The free tier is limited to 1,000 memories and 3 spaces. Additional features and increased limits are available through paid subscriptions.

API and MCP Usage

Use of our API and MCP server is subject to rate limits and fair use policies. We reserve the right to throttle or suspend access for excessive or abusive usage.

Intellectual Property

The Service, including its design, features, and underlying technology, is owned by One Silly App LLC and protected by intellectual property laws. The open-source memable library is licensed under the MIT License.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONE SILLY APP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless One Silly App LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the date above. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of the United States and the State of Illinois, without regard to conflict of law provisions.
